There is a one-off fee per website. Please contact us for a quotation.

Other costs
There may be additional integration costs depending on whether re:write is being added to an existing website or any other special requirements your website may have over and above the base software features. This is assessed on a site-to-site basis but will be made clear in our quotation.

Terms & Conditions
re:write is a Content Management application framework for websites, supplied by White Total Design Limited (WTD).

YOUR PURCHASING OF A LICENSE AND USE OF THE SOFTWARE SIGNIFIES THAT YOU AGREE TO THE FOLLOWING TERMS OF USE AND YOU CONSENT TO THE FOLLOWING TERMS AND CONDITIONS DISCLOSED HEREIN. YOU AND WTD INTEND THAT THIS IS A BINDING LEGAL AGREEMENT. IF YOU DO NOT AGREE WITH ANY OR ALL OF THESE TERMS, DO NOT USE THE SOFTWARE. VIOLATION OF THESE TERMS OF SERVICE WILL RESULT IN THE LOSS OF SUPPORT FOR YOUR SOFTWARE. REDISTRIBUTION OR REVERSE-ENGINEERING OF ANY COMPONENT OF THE SOFTWARE WILL RESULT IN CRIMINAL PROCEEDINGS.

Paying a single license fee, and any associated costs, entitles you to the use of the re:write application for one web domain.

Integration of the re:write application into your website will be carried out by White Total Design developers. If you are hosting the website with your own selected hosting company you agree to make sure that a suitable hosting account is in place. If you are using WTD to provide the website hosting then WTD will provide a compatible account.

Changes to the terms of service
We may change these Terms at any time. You can review the most current version of these terms by visiting this web page. You are responsible for checking these terms periodically for changes. If you continue to use the software after we post changes to these Terms of Use, you are signifying your acceptance of the new terms.

Terms of Use
You may use the re:write software for lawful, authorized purposes and only in accordance with these Terms of Service.

  1. You agree not to make any changes to the re:write application files hosted in your web space. This restriction applies to all files in the /rewrite folder and those in the /bin folder
  2. You agree not to re-distribute, re-use, decompile or attempt to reverse-engineer any component of the re:write software
  3. You are responsible for maintaining the security of your account and password. WTD  accepts no responsibility or liability for any loss or damage arising from your failure to comply with this security obligation
  4. You are responsible for all the content posted to your website using the re:write application. You are not allowed to post any content which infringes any patent, trade mark, trade secret, copyright or other proprietary right.
  5. Ownership of all files relating to the re:write application remains with WTD.

Disclaimer of Warranties
We provide re:write “as is”. We make no express warranties or guarantees about re:write. To the extent permitted by law, we disclaim implied warranties that re:write and all software, content and services distributed through re:write are merchantable, of satisfactory quality, accurate, timely, fit for a particular purpose or need, or non-infringing. We do not guarantee that re:write will meet your requirements, is error-free, reliable, without interruption or available at all times. We do not guarantee that the results that may be obtained from the use of re:write, including any support services, will be effective, reliable, accurate or meet your requirements. No oral or written information or advice given by a re:write representative shall create a warranty. You may have additional consumer rights under your local laws that this contract cannot change depending upon the jurisdiction in which the Software is utilized.

Indemnification

  1. The Client agrees that it shall defend, indemnify, save and hold WHITE TOTAL DESIGN harmless from any and all demands, liabilities, losses, costs and claims including the reasonable legal fees asserted against WHITE TOTAL DESIGN, its agents, its Clients, officers and employees that may arise as a result from the proper performance by WHITE TOTAL DESIGN of the Service.
  2. The Client agrees to defend, indemnify and hold harmless WHITE TOTAL DESIGN against any liability arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with the Service and the Client warrants that it shall maintain adequate insurance against such risks at all times.
  3. The Client agrees to defend, indemnify and hold harmless WHITE TOTAL DESIGN for any product supplied by the Client which transpires to be defective and is bought through a website hosted by or through WHITE TOTAL DESIGN.

Limitation of liability

  1. The liability of WHITE TOTAL DESIGN under the Contract or in tort or otherwise shall not exceed the greater of the sums paid by the Client under the contract or such sum as shall be receivable by WHITE TOTAL DESIGN in respect of any claim under any insurance policy effected by WHITE TOTAL DESIGN from time to time.
  2. WHITE TOTAL DESIGN shall not be liable for any indirect special incidental or consequential loss including loss of sales/profit or production, opportunity, damage to goodwill/reputation.
  3. Nothing shall restrict or exclude the liability of WHITE TOTAL DESIGN for death or personal injury arising as a result of its negligence.
  4. WHITE TOTAL DESIGN reserves the right upon notice to the Client to introduce and revise its policies (as distinct from agreed contractual terms) relating to its hosting (or procurement of hosting), operation and maintenance of a website at any time.
  5. The Client agrees that WHITE TOTAL DESIGN will not be liable for any data that fails to be delivered, any mis-delivery, corruption, destruction or other modification to the Client’s website unless this shall be the direct result of WHITE TOTAL DESIGN’s negligence.
  6. The Client agrees that WHITE TOTAL DESIGN will not be liable for any event beyond WHITE TOTAL DESIGN’s reasonable control.

Dispute resolution
In the event of any dispute regarding the Contract and/or any of these provisions or their interpretation then WHITE TOTAL DESIGN reserves the right where having regard to the nature of the dispute it considers it appropriate, to refer the matter to an expert to be agreed or in the absence thereof to be appointed by the President for the time being of The Law Society upon the application of WHITE TOTAL DESIGN whose decision shall be final and binding upon WHITE TOTAL DESIGN and the Client and whose costs shall be borne equally by WHITE TOTAL DESIGN and the Client unless the expert shall stipulate otherwise.

Legal
The Contract shall be subject to English Law and under the non-exclusive jurisdiction of the English Courts and the appropriate County Court shall be the Southampton County Court or High Court as appropriate.

Severability
Any of these provisions which may be unenforceable shall (to that extent) be severable.
